What is direct Representation?

When you are preparing to import or export goods in or out of the UK, you will need to ensure you have a Customs Clearance Agent UK, as they will handle the submission of import or export customs declarations on our behalf.

Often a Customs Clearance Agents UK will ask you to sign a letter of ‘Direct Representation’ before they will complete import or export declarations on your behalf. This shows UK Customs that the Customs Clearance Agents UK has authority to submit these declarations on the individual or business’s behalf who is trading the goods and holds them accountable for the information they provide to the customs agent.

Direct Representation means the Customs Clearance Agents UK is responsible for submitting declarations on the exporter or importers behalf, however, whilst the Customs Clearance Agents UK is completing and submitting the declarations, legally the business or individual who is shipping the goods is responsible for supplying the correct information to the Customs Clearance Agents UK for them to be completed accurately. This means that the Customs Clearance Agents UK is only representing the individual or business who are declaring the goods, the importer or exporter who they are representing is legally responsible for the accuracy of the information on the customs declaration and compliance with customs regulations.

It is also the responsibility of the business or individual importing or exporting the goods that all taxes and duties are paid, however, the Customs Clearance Agents UK will usually handle payment for these directly to HMRC on the client’s behalf and then invoice this to the business or individual. Most of the Customs Clearance Agents UK will require prepayment of the taxes and duties before they proceed with payment to HMRC to allow the goods to change to cleared status and enter free circulation within the UK.

When a Customs Clearance Agents UK is acting as ‘Direct Representative’ of the importer or exporter, they must follow the instructions of the business or individual, however they can offer professional customs advise on rules and regulations of what is allowed and what is not for both imports and exports. It is then down to the business or individual responsible for those goods to make an informed decision with regards of the customs procedure they choose to follow.
